These Terms of Service ("Terms," "Terms of Service") govern your use of our online test automation service and related web pages located at https://tacl.io and https://app.tacl.io (collectively, the "Service").

Our Privacy Policy, located at https://tacl.io/privacy, also governs your use of our Service and explains how we collect, safeguard, and disclose information resulting from your use of our web pages.

By accessing or using the Service, or by clicking a button or checking a box marked "I Agree" (or similar), you acknowledge that you have read and understood the Agreements and agree to be bound by them, whether or not you are a registered user. We reserve the right to modify these Terms, as described below.

If you are accessing or using the Service on behalf of an organization with enterprise requirements, please review our professional plan options for enterprise clients, which may be more suitable for you.

If you do not agree with these Agreements, you may not use the Service, but please let us know at support@tacl.io so we can help you. These Terms apply to all visitors, users, and others who wish to access or use the Service ("Users").

PLEASE READ THESE TERMS CAREFULLY. THESE TERMS CONTAIN A MANDATORY INDIVIDUAL ARBITRATION AGREEMENT AND CLASS ACTION/JURY TRIAL WAIVER THAT REQUIRE, UNLESS OPTED OUT, THE EXCLUSIVE USE OF FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES.

Eligibility

This is a contract between you and tacl.io. You must read and agree to these Terms before using the Service. You may use the Service only if you can form a binding contract with tacl.io and comply with these Terms and all applicable laws and regulations. Any access to the Service by individuals under the age of 13 (or under 16 in Europe) is prohibited.

Limited License

Subject to these Terms, we grant you a non-exclusive, limited, non-transferable, freely revocable license to use the Service as permitted by its features. tacl.io reserves all rights not expressly granted herein. This license may be terminated at any time.

Accounts

Creating an account grants you access to our Service’s features and functionalities. We may maintain different types of accounts for different users.

If you are using the Service on behalf of an organization, these Terms apply to both you and the organization. You must ensure that all information provided on behalf of your organization is accurate. If your organization is responsible for payment, we may consider you to be using the Service on its behalf.

When you create an account, you confirm that you are at least 18 years old and agree to provide accurate, complete, and current information. Failure to comply may lead to account termination.

You are responsible for maintaining the confidentiality of your account and for all activities under it. You agree to notify us immediately of any security breach. You may not use another user's account without permission.

Prohibited Uses

Service Location

Our Service is primarily operated from Frankfurt, Germany. Additional data center locations may be added in the future. Compliance with local laws in other jurisdictions is your responsibility if you access the Service from outside this region.

User Content

Some areas of the Service allow you to post or submit content ("User Content"). We claim no ownership of your User Content; it remains yours. However, by submitting any User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute it as needed for the Service.

Intellectual Property Rights

Company Content

Except for your User Content, all content on the Service, including software, images, text, graphics, logos, and other materials ("Company Content"), is the exclusive property of tacl.io. Unauthorized use is prohibited.

Output

Subject to these Terms, you may use any output generated by the Service ("Output") for lawful purposes, provided you understand and agree that the output may not be unique to you and could be generated similarly for other users.

Usage Data

We may collect usage data (diagnostic and technical information). This data is exclusively owned by us and may be used to maintain and improve the Service, conduct research, and share aggregated insights.

Error Reporting and Feedback

You may submit error reports or feedback tosupport@tacl.io. By doing so, you grant us a royalty-free, unlimited license to use and incorporate your feedback into the Service.

Paid Services

Billing Policies

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). Subscription options include monthly or annual billing cycles.

Purchases

To make a purchase, you may be required to provide billing information. We may use third-party services to process payments, and by submitting your information, you authorize us to share it with these third parties.

Subscriptions & Cancellation

At the end of each billing cycle, your subscription will automatically renew unless you cancel it through your account or by contacting us. We may modify the Subscription terms or pricing at our discretion.

Free Trials

We may, at our discretion, offer free trials. If you do not cancel before the trial ends, you will be automatically charged according to your selected subscription.

Refunds

There are no refunds for cancellations. If your account is terminated, you will not receive any refunds for unused time or fees paid.

Privacy and Data Security

Please review our Privacy Policy for information on how we collect and use data. While we take security seriously, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures.

These Terms will be governed by either U.S. or European laws, depending on the final jurisdiction selection.

Additional Terms for Mobile Applications

If tacl.io offers a mobile app, additional terms may apply for users downloading the app from app stores.

General

These Terms, including any updates or modifications, represent the entire agreement between you and tacl.io. If any part of these Terms is deemed invalid, the remaining terms will remain in effect.
